How to register real estate in Egypt

After full payment for the property and delivery of the property by the developer (if the property is being purchased under construction), the owner issues a taukil.

A taukil is an irrevocable power of attorney for the right to own and dispose of the acquired property, which is issued by a notary only in Arabic based on the seller’s application and then transferred to the buyer.

The procedure is carried out in a notary office – Shara-Akari, whose representative offices are located in Cairo, Hurghada, Sharm el-Sheikh and Qena. A taukil can also be issued at the Egyptian embassy in other countries.

In fact, the execution of a taukil takes no more than three hours, however, as a rule, a longer period is specified in the contract, since the developer/owner is often abroad.

Based on the purchase and sale agreement and taukil, the buyer becomes the full owner of the property.

Registration (legalization) of the transaction is not mandatory. It is carried out at the request of the buyer, but is recommended for non-residents of Egypt.

There are two ways to register ownership.

Registration of the contract in court. The purchase and sale agreement is registered in the court (sahih taukiya) at the location of the acquired property. As a result, you receive a court ruling that the transaction, the signatures of the parties and the purchase and sale agreement are recognized as legal. The process takes from two to four months.

A green contract is a document issued in the name of the owner (or several owners), confirming that the property is registered in the unified state register of real estate through the Shara-Akari (notary office). In this way, the state guarantees the inviolability of property. Previously, the process took from six months to a year, but Law No. 9 of 2022 provided for several amendments to facilitate the registration procedure and reduced the waiting time for property registration to 37 days.
